Our Terms

Fresh N Fast Lunch Box asks that the person making the order ("the Purchaser") reads the terms and conditions below ('the Agreement") before placing an order for our healthy fresh school lunches. Fresh N Fast Lunch Box reserves the right to amend or update these terms and conditions at any time. By registering either at the school or on the Fresh N Fast Lunch Box website, the Purchaser agrees to be bound by the following terms and conditions;

1. Our Orders

1.1 The Purchaser agrees to a minimum order of AUD$20.00 if making an internet order ("Internet Order").
1.2 When ordering at the school ("Manual Order"), the Purchaser agrees to provide an Fresh N Fast Lunch Box representative with exact change in a sealed envelope on the morning of ordering.
1.3 The Purchaser agrees to place a Manual Order with an Fresh N Fast Lunch Box representative only, who will be at the school on the morning of ordering to collect all orders.
1.4 An Internet Order will be deemed to have been received by Fresh N Fast Lunch Box upon successful transmission of the order.
1.5 A Manual Order will be deemed to have been received by Fresh N Fast Lunch Box on the collection of it at the school by an Fresh N Fast Lunch Box representative.

2. Our Cancellations

2.1 The Purchaser agrees to cancel an order no later then 9.00am the morning of delivery, in which case the Purchaser will receive a credit for their next order.
2.2 Any credit must be used within an 8 week period, failing which the credit will be cancelled.
2.3 A Purchaser who cancels an order after 9.00am on the morning of delivery will not be given a credit for their next order.
2.4 If at any time the Purchaser is not satisfied with the quality of a particular lunch the Purchaser may contact Fresh N Fast Lunch Box on 1300 308 779 and Fresh N Fast Lunch Box will assess the Purchasers’ complaint . If Fresh N Fast Lunch Box in its reasonable opinion believes the lunch is unsatisfactory the Purchaser will be given a credit for their next lunch, such credit to be used within an 8 week period. Fresh N Fast Lunch Box reserves the right to decline a credit to the Purchaser if it believes in its reasonable opinion that the Purchasers’ complaint is unwarranted

3. Our Menu

3.1 The Fresh N Fast Lunch Box menu will be reviewed and updated each term using your valued feedback; therefore we will not cater to individual orders that are not on our menu for that term.
3.2 At all times, Fresh N Fast Lunch Box will endeavor to be as accurate as possible with its product provision, however, should the product not be available, we reserve the right to replace it with a substitute product of equal value without notice.
3.3 As the menu will be reviewed each term, Fresh N Fast Lunch Box reserves the right to alter prices for lunches on the menu from time to time. The Purchaser will be taken to be aware of such changes when re-ordering either via the website or through the manual order form where the change will be indicated. The Purchaser's use of the Fresh N Fast Lunch Box service after such changes will be deemed acceptance of the price changes.
3.4 All prices on the Fresh N Fast Lunch Box menu will be GST inclusive.
3.5 The Purchaser will be taken to have read the ingredients list either via the internet or attached to the Manual Order form when placing an order. The Purchaser will therefore be taken to be aware of any foods that may cause an allergy if consumed by their child.

4. Our deliveries

4.1 Fresh N Fast Lunch Box will take every reasonable precaution to ensure that school lunches are delivered by lunchtime at the school.

5. Our Notification of changes

5.1 Fresh N Fast Lunch Box reserves the right to add to, delete or otherwise change, any of the terms of this Agreement by giving notice to the Purchaser via electronic mail or by letter collected at the school when making a Manual Order. The Purchaser's use of the Fresh N Fast Lunch Box service after such notice will be deemed acceptance of such changes.

6. Our Liability Clause

6.1 Fresh N Fast Lunch Box will not be liable for any delay or failure to perform its obligations if such failure or delay is due to an occurrence beyond the reasonable control of Fresh N Fast Lunch Box which prohibits Fresh N Fast Lunch Box from performing its obligations including but not limited to accidents, strikes, work stoppages, labour difficulties, transportation difficulties, materials shortages and inaccurate ordering by the Purchaser.
6.2 Fresh N Fast Lunch Box does not accept liability for errors, omissions in, delays or interruptions to or cessation of access to this website for any reason whatsoever.
6.3 To the maximum extent permitted by law, Fresh N Fast Lunch Box excludes any warranty that would otherwise be implied in respect of the supply of the lunches.
6.4 To the extent permitted by law, Fresh N Fast Lunch Box limits its liability arising under this Agreement and in connection with supplying the lunches to the sum paid by the Purchaser for the lunches.

7. Our Termination Clause

7.1 Fresh N Fast Lunch Box may terminate or suspend this Agreement at any time by giving notice to the Purchaser via electronic mail or by letter collected at the school when making a Manual Order. Fresh N Fast Lunch Box will give at least 4 weeks notice of such termination or suspension.
7.2 Fresh N Fast Lunch Box reserves the right to withdraw completely, or suspend for a period of time, this website or access to it without notice if: (a) there is an interruption, fault, virus, unauthorised access, denial of service or other malicious attack on any part of our computer or telecommunications system; (b) if this website is used for an inappropriate purpose.

8. Our Copyright

8.1 This website is protected by copyright which Fresh N Fast Group Pty Ltd owns. The Purchaser or any other person using this website must not reproduce any part of it without the prior written permission of Fresh.

10. Our Laws

10.1 This Agreement will be construed in accordance with the law of NSW.
